Opportunity for Additional Flexibility for Districts on Title I Funds
Tennessee is requesting a waiver (access request here) from the U.S. Department of Education of the limitation in section 1127(b) of the Elementary and Secondary Education Act of 1965 (ESEA) which would permit the state department of education to grant a carryover limitation waiver to an LEA more than once in a three-year period. If granted, this would mean that even LEAs who have carried over Title I funds in the past three years could apply to the state for a waiver to do so again for the coming fiscal year. If the state is granted the proposed waiver, we will share additional information at that point on how to submit an LEA waiver for carryover.
We believe the requested waiver may help LEAs direct and budget their funds more thoughtfully with this additional flexibility. Exercising this additional waiver is also beneficial for LEAs as it could lessen the impact of sequestration on the 2013-14 school year.

All comments will be included in the state's waiver request to the U.S. Department of Education. Please also feel free to reach out to Eve with any questions about the state or LEA waiver process.
