New Law Change Affects Tank Owners and Distributors

Facilities appearing on this list should not be receiving petroleum deliveries, nor should they be selling petroleum. This List will be updated on a regular basis.

Background

Petroleum distributors were also impacted by changes to the Petroleum Underground Storage Tank Act in 2004. The new law allows the Commissioner to "…affix a notice or tag to a dispenser and/or fill port and/or give notice on the department web site for any tank that does not have a current certificate."

The law requires each petroleum facility to prominently display a current valid certificate. An Underground Storage Tank certificate is issued for a period of one year after the tank owner has properly registered all tanks and paid all current and past due fees and any applicable late charges. The certificate is mailed to the tank owner who must post it at the facility.

The Division has chosen to publish a list on the Division website of those facilities that have not been issued a current certificate. The list will also contain those facilities where the Division has taken enforcement action to revoke a valid certificate.

It is an unlawful act to place petroleum into a tank that does not have a current, valid certificate properly posted. It is unlawful for anyone placing petroleum into tanks at such facilities, or causing petroleum to be placed into such tanks. The Division has imposed significant fines for petroleum deliveries to facilities without certificates and will continue to do so. This new law is to help distributors be aware of those facilities that do not have valid certificates.
