Water Related Enforcement Activity
Certain water related enforcement activity is posted weekly to this Web page, including Director’s Orders, Commissioner’s Orders, Agreed Orders and Rulings of the Water Quality Control Board and Notices of Intent to Appeal. When cases are appealed, the law (T.C.A. §4-5-310) provides an opportunity to intervene to become a party in the pending case. To do so, a petition should be filed with the Secretary of State, Administrative Procedures Division. Water related enforcement activity for the most recent week is identified and presented with short summary and link to full documentation through the Case No. Previous water related enforcement activity are archived in batch links at the bottom of this page.
Timely access to public information is important to the department. We are developing an online application that will connect to a database containing enforcement activities across all department divisions. | Summary:Respondents are developers of a subdivision and golf course near Tellico Lake in Loudon county. This Order addresses several violations of the Water Quality Control Act. These violations include, but are not limited to, failing to install and maintain adequate sediment and erosion control measures to control storm water runoff; conducting activities without a permit and causing a condition of pollution to waters of the state. This Order requires the Respondent to seed and straw disturbed areas of the site without vegetative cover, maintain EPSCs, submit updated SWPPP and applications for permits to remove sediment, submit for approval a restoration plan, implement the approved resotration plan and provide documentation of attendance and successful completion of the Department's EPSC workshop. The Order assesses a civil penalty of $338,500, of which $127,900 is non-contingent and $210,600 is contingent. Damages of $2,023.15 are also assessed. | |||||

Causing a condition of pollution to unnamed tributaries of North Fork Choate Creek, North Fork Choate Creek and Choate Creek. This Order assesses a Civil Penalty of $50,000.00 and a Natural Resource Damage Assessment of $387,670.20. The following Order was issued by the Commissioner on April 21, 2008: Case Name: Tennessee Department of Transportation and Dement Construction Company Case # : WPC07-0186 Division: WPC Attorney: Devin Wells County: Giles and Lawrence TDOT is undertaking a project to widen SR-15 ("site") in Lawrence County. Dement Construction Company is contracted by TDOT to conduct construction activities at the site. This Order addresses several violations of the Water Quality Control Act. These violations include, but are not limited to, failing to install and maintain adequate EPSC measures to control storm water runoff, and causing a condition of pollution. This Order requires the Respondent to submit to the Division a detailed description of the measures to be implemented to ensure accurate and timely discovery and reporting of sediment releases off site and/or to waters of the state. The Order assesses a civil penalty of $50,000.00 and Natural Resource Damage Assessment in the amount of $312,659.40. | ||||
