TO WHOM IT MAY CONCERN: Below are current public notices of permit applications, notice of individual permit decisions, announcement of public hearings or meetings, and/or rule-making activities. Public comment and participation are encouraged on all of these issues.
The applications described below have been submitted for Aquatic Resource Alteration Permits under The Tennessee Water Quality Control Act of 1977, T.C.A. §69-3-108. In addition, a federal permit may be required from the U. S. Army Corps of Engineers or from the Tennessee Valley Authority under §404 of the Clean Water Act and §26a of the Tennessee Valley Authority Act , respectively. Section 401 of the Clean Water Act requires that an applicant must obtain a water quality certification from the state when a federal permit is required. These notices may cover applications subject to §401 or navigation permitting (Rule 1200-04-08).
No decision has been made whether to issue or deny these permits. The
purpose of these notices is to inform interested parties of this permit
application and to ask for comments and information necessary to determine
possible impact to water quality. Persons wishing to comment on a proposal
are invited to submit written comments to the department. Written comments
must be received within thirty days of the date that the notice is posted.
Comments will become part of the record and will be considered in the
final decision. The applicant’s name and permit number should be
referenced.
The permit application, supporting documentation including detailed plans
and maps, and related comments are available for review and/or copying
at the department’s Natural Resources Section.
Interested persons may also request in writing that the department hold a public hearing on an application. The request must be filed within the comment period, indicate the interest of the person requesting it, the reasons that the hearing is warranted, and the water quality issues being raised. When there is sufficient public interest in water quality issues, the department shall hold a public hearing in accordance with Rule 1200-4-7-.04(4)(f).
In deciding whether to issue or deny a permit, the department will consider all comments of record and the requirements of applicable federal and state laws. In making this decision, a determination will be made regarding the potential lost value of the resource compared to the value of any proposed mitigation. The department shall consider practicable alternatives to the alteration. The department shall also consider loss of waters or habitat, diminishment in biological diversity, cumulative or secondary impacts to the water resource, and adverse impact to unique, high quality, or impaired waters.

NRS09.028 City of Knoxville proposes to conduct activities associated with the construction of the Middle Section of the proposed Knoxville South Waterfront Development and includes the construction of approximately 1,920 linear feet of at-grade riverfront walkway, extending from Tennessee River Mile 648.02 to River Mile 648.44, fill of approximately 0.14 acres of wetland and the creation of 0.48 acres of wetland, redesign approximately 2,235 linear feet of riverbank by regarding, stabilizing and planting with native woody vegetation, construct a 115 ft. X 25 ft. pile supported timber pier and an 80 ft. X 30 ft. concrete kayak ramp. Approximately 106 cubic yards of material will be placed riverward of normal pool elevation behind sheet pile wall, construct a 30 ft. X 120 ft. pile supported dock, and construct 1,600 linear feet of road and sidewalk running parallel to Langford Avenue and connecting to the Northern end of Lincoln Street, and construct a 20-car capacity surface parking area adjacent to the proposed kayak landing.
NRS 09.048 TDOT proposes to reconstruct 2.361 miles of SR-20 from the Henderson County Line to Bear Creek Road near Parsons along existing alignment. Mitigation for stream impacts not mitigated on site (1228’) would be mitigated by payment of $245,600.00 to the Tennessee Stream Mitigation Program. Wetland impacts (0.858 ac) would be mitigated by debiting, at a 4:1 ratio, 3.43 acres of available credit from the Obion Wetland Mitigation Bank. Decatur County.
NRS 09.050 TDOT proposes to construct approximately 0.383 miles of SR-2 (US-11) along an existing alignment. The existing centerline of SR-2 will be shifted approximately 40-50 ft. north, removing the existing S-curve. The new construction will consist of one (1) new 520 ft. 4-span concrete girder bridge over Lookout Creek (STR-1), outfall structure and utility line crossing in an unnamed tributary to Lookout Creek (STR-2), four (4) 12-ft. lanes, 10-ft. shoulders, 21 ft. typical to ditch centerline and varied guardrail. This will also include the relocation of approximately 200 ft. of a second unnamed tributary to Lookout Creek (STR-3), which will be replaced on-site and in-kind. Lookout Creek and 2 tributaries to Lookout Creek, Hamilton County.
NRS09.051 TDOT proposes to construct approximately 0.123 miles of SR-131 along an existing alignment. The new construction will consist of two (2) 12-ft. lanes, 8ft. shoulders (6 ft. paved, 2-ft. sod), and varied guardrail. Construction will consist of replacing the existing 1-lane bridge over Meadow Creek with 51.5ft. of 3@16ft. X 6ft. slab bridge and associated rip-rap, associated outfalls, approximately 0.120 acres of wetland fill, and partial relocation of Meadow Creek and two (2) tributaries to Meadow Creek to avoid fill from a wider roadway. Applicant proposes to mitigate for relocation activities by providing on-site replacement in-kind. For 10ft. of stream loss the applicant proposes payment to the TSMP. For 0.123 acres of permanent wetland impact the applicant proposes debiting 0.24 acres of available credits at the Shady Valley Wetland Mitigation Bank. Knox County

NRS 08.122 Erich Strehl The applicant is proposing to reroute a small portion of stream and install a retaining wall in order to construct a house on the 0.25 acre lot. As a result, approximately 30 linear feet of stream would be disturbed, the stream shifted approximately 5 feet to the west, an approximate 4 foot high retaining wall would be constructed along the left bank. NRS08.280 The City of Clarksville proposes to construct a public recreational boating facility to accommodate both transient and seasonal boaters with docks, service, fueling and sanitary pump out facilities. The rental dock provides 198 slips. In order to construct the facility 986,000 cubic yards of material will be excavated and impacts will occur to 6.655 acres of wetland and 1,104 feet of two unnamed tributaries to the Cumberland River; Clarksville, Montgomery County.
NRS 09.027 Betty Hughes proposes the placement approximately 600 linear feet of rip rap for erosion prevention on left bank. Buffalo River. Wayne County.
NRS09.043 TDOT proposes to construct approximately 4.156 miles of SR-66 along an existing alignment for public use. The 0.25 miles of new construction from Sta. 51+00± to Station 74+30± will consist of 4 to 5, (10) ft. to 12 ft. lanes, 1 to 2 varied left turn lanes, 0 to 12 ft. shoulders, 2.5 ft. curb and gutter, 5ft. to 7ft. sidewalks, 1ft. to 6ft. sod shoulders, and varied guardrail. The 3.92 miles of new construction from Station 74+30± to Station 270+50± will consist of 6 traffic lanes, 24ft. to 48ft. raised median, 12 ft. shoulders, 2.5ft. curb and gutter, 7ft. sidewalks, 6ft. sod shoulders, and varied guardrail. The proposed impacts to aquatic resources are extensions of existing structures (road crossings). This will include the removal of the existing structures in Greasy Creek and Branch Creek and replacing them with box bridge/culvert structures, installation of new outfall structures associated with these crossings and temporary turnarounds at these locations, and installation of two utility line crossings for 8-inch water line and removal of existing line. The project is to widen the existing 2-lane roadway on U.S.64 to a 4-lane divided highway. The applicant proposes the following impacts to aquatic resources:
