AN ACT To amend Tennessee Code Annotated, Section 49-2-301(f) and Section 49-5-510, relative to assigned and other duties of superintendents.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:

SECTION 1. Tennessee Code Annotated, Section 49-2-301(f), is amended by deleting subdivision (31) in its entirety and substituting instead the following:

(31) Within the approved budget and consistent with existing state laws, board policies and locally negotiated agreements covering licensed personnel, to employ, transfer, suspend, non-renew and dismiss all personnel, licensed or otherwise, except as provided in Section 49-2-203(a)(1) and in Chapter 5, Part 5 of this title. Nothing in this subdivision shall be construed to alter, diminish, or supersede the Educational Professional Negotiations Act, Tennessee Code Annotated, Title 49, Chapter 5, Part 6.

SECTION 2. Tennessee Code Annotated, Section 49-5-510, is amended by deleting the word and punctuation "licensed." and substituting instead the following words and punctuation:

licensed; provided, however, that transfers shall be acted upon in accordance with board policy and any locally negotiated agreement.

SECTION 3. This act shall take effect upon becoming a law, the public welfare requiring it.
