AN ACT to amend Tennessee Code Annotated, Section 67-5-1301, relative to the assessment of utilities and carriers by the Comptroller of the Treasury.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:

SECTION 1. Tennessee Code Annotated, Section 67-5-1301(13), is hereby amended by deleting the language "and which hold a certificate of convenience and necessity from the Department of Transportation, the Interstate Commerce Comptroller or any other federal or state regulatory agency." And by substituting instead the following language:

which are registered with the U.S. Army Corps of Engineers or any other federal or state agency and/or domiciled in this State and/or owning or leasing real or personal property located in this State.

SECTION 2. This act shall take effect on becoming law, the public welfare requiring it, and shall apply to assessments made for the 1998 tax year.
