Substituted for: House Bill No. 1358

AN ACT To amend Tennessee Code Annotated, Title 39, Chapter 17, Part 7, relative to the home manufacture of certain alcoholic beverages.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:

SECTION 1. Tennessee Code Annotated, Section 39-17-708(a), is amended by deleting from the first and second sentences the word "wine" and by substituting instead the words "wine or beer".

Tennessee Code Annotated, Section 39-17-708(a), is further amended by deleting from the first sentence the word, figures and punctuation "April 30, 1973" and by substituting instead the word, figures and punctuation "January 1, 1997".

SECTION 2. Tennessee Code Annotated, Section 39-17-708(a), is further amended by deleting from the first sentence the word "members" and by substituting instead the words "members and guests".

Tennessee Code Annotated, Section 39-17-708(a), is further amended by deleting from the second sentence the word "person" and by substituting instead the words and punctuation "person, member or guest".

SECTION 3. Tennessee Code Annotated, Section 39-17-708, is amended by adding the following new subsection:

(c) For purposes of this section, "beer" means the undistilled and unfortified product, of any name or description, of the normal alcoholic fermentation of malt and/or other ingredients except grapes.

SECTION 4. This act shall take effect upon becoming a law, the public welfare requiring it.
