AN ACT
To amend Tennessee Code Annotated, Title 40, Chapter 33 and Title 55, relative to the confiscation, forfeiture and sale of certain property.BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:
SECTION 1. Tennessee Code Annotated, Section 40-33-211, is amended by deleting from the first sentence of subsection (c)(1) the language "fifteen percent (15%)" and substituting instead the language "thirty percent (30%)".
SECTION 2. Tennessee Code Annotated, Section 40-33-211, is further amended by deleting from the first sentence of subsection (c)(2) the language "eighty-five percent (85%)" and substituting instead the language "seventy percent (70%)".
SECTION 3. Tennessee Code Annotated, Section 40-33-211(c)(2), is amended by deleting the words and figures "July 1, 1997" wherever the same may appear and by substituting instead the word and figures "January 1, 1998".
SECTION 4. Tennessee Code Annotated, Section 40-33-211(f)(2), is amended by deleting the word and figures "January 1, 1997" wherever the same may appear and by substituting instead the word and figures "January 1, 1998".
SECTION 5. Tennessee Code Annotated, Section 40-33-211, is amended by deleting from the first sentence of subsection (f)(1) the language "fifteen percent (15%) and substituting instead the language "thirty percent (30%)".
SECTION 6. Tennessee Code Annotated, Section 40-33-211, is further amended by deleting from the first sentence of subsection (f)(2) the language "eighty-five percent (85%)" and substituting instead the language "seventy percent (70%)".
SECTION 7. This act shall take effect upon becoming a law, the public welfare requiring it and shall apply to all revenue derived from sales of forfeited vehicles occurring on or after such effective date.
