AN ACT to amend Tennessee Code Annotated, Section 8-47-122, relative to removal of public officers.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:

SECTION 1. Tennessee Code Annotated, Section 8-47-122, is amended by redesignating the existing section as subsection (a) and by adding the following as subsection (b):

(b) Notwithstanding the provisions of subsection (a) of this section or any other provision of law to the contrary, the complainant may be taxed for costs and attorney's fees pursuant to Rule 11 of the Tennessee Rules of Civil Procedure, if the complaint or petition is withdrawn or if the court finds the charges alleged to be without merit.

SECTION 2. This act shall take effect upon becoming a law, the public welfare requiring it.
