Substituted for: House Bill No. 1680

AN ACT To amend Tennessee Code Annotated, Title 57, Chapter 5, Part 3, relative to penalties for certain beer sales.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:

SECTION 1. Tennessee Code Annotated, Section 57-5-301(d), is amended by deleting subdivision (2) and substituting instead the following:

Any person who purchases any such beverage for or on behalf of a person under twenty-one (21) years of age commits a Class A misdemeanor and in addition to the punishment authorized by §40-35-111 may be punished by not more than thirty (30) days of community service work.

SECTION 2. Tennessee Code Annotated, Section 57-5-301(d)(3)(A), is amended by deleting from the first sentence the language "fifty dollars ($50.00) or not less than twenty (20) hours of community service work," and by substituting instead the language "not less than fifty ($50.00) nor more than two hundred fifty dollars ($250.00) or not less than twenty (20) hours of community service work, or both,".

SECTION 3. Tennessee Code Annotated, Section 57-5-301(d)(3)(B), is amended by deleting from the first sentence the language "two hundred dollars ($200)" and substituting instead the language "five hundred dollars ($500)".

SECTION 4. This act shall take effect July 1, 1997, the public welfare requiring it.
