Progress During FY 2004

Through its ongoing monitoring of the implementation of PC 1101 the Tennessee Advisory Committee on Intergovernmental Relations (TACIR) has identified the following major implementation developments for Public Chapter 1101 during Fiscal Year 2004 listed below:

  • Polk County and Fayette County had their growth plans approved by the Local Government Planning Advisory Committee (LGPAC) in 2003. Both of these counties utilized the arbitration process administered by the Secretary of State’s office.
  • All 92 counties required to have approved growth plans now have them in place.
  • The Commissioner of the Department of Economic and Community Development issued an important policy statement to all local governments across the state concerning the documentation of their Joint Economic and Community Development Board (JECDB) activities.
  • Beginning September 1, 2003 all state grant applications administered by ECD must include supporting documentation that the county JECDB was legally established and been meeting according to the statute.
  • By July 1, 2004 every local government applying for a state grant administered by ECD must provide records that document that their JECDB has met the minimum number of times during the previous twelve months.
  • By the end of FY 2003, there were 89 counties in Tennessee eligible to amend their growth plans should they decide to do so.
  • There was one new piece of legislation passed in 2003 that could affect local growth plans. HB 647 (Stanley)/SB 733 (Norris) authorizes two or more local governments to form a joint corridor central business district.
  • The Attorney General issued three (3) opinions on various aspects of the Act.
  • The Commission continued its discussion of issues of concern related to PC 1101 and began a discussion about possible amendments to the statute.

Preliminary Activities During FY 2005

Below are a few of the major issues dealing with PC 1101 that TACIR will be monitoring or involved in during FY 2005.

  • There are 10 bills pending in the General Assembly dealing with aspects of PC 1101 that have been referred to TACIR for study.
  • The Department of Economic and Community Development (ECD) will be implementing its new policy on the documentation of the activities of the JECDBs.
