Office of Administrative Appeals

The operations of DIDD’s Office of Administrative Appeals (OAA) are based on rules issued by the department and filed with the Secretary of State’s Office. These rules became effective on November 4, 2018. The rules provide due process appeal rights to persons who are substantiated at the Class I level for abuse, neglect or exploitation. The rules apply only to persons substantiated for incidents in which the person supported was receiving services under one of Tennessee’s 1915(c) waivers or through TennCare ECF programs. Two types of appeals will be available: file review by the OAA, and/or a hearing conducted by an administrative law judge of the Secretary of State’s Administrative Procedures Division.
