Public Notice - Summer Food Service Program USDA FNS Waiver Requests

TN Department of Human Services (DHS) is requesting three waivers from USDA FNS in its operation of the Summer Food Service Program (SFSP).

  • First week site visits requirement at 7 CFR 225.15(d)(2) which requires sponsors to visit each of their sites at least once during the first week of operation under the program.
  • Applications for closed enrolled sites requirement at 42 U.S.C. 1761(a)(1)(A)(i)(lll) and 7 CFR 225.15(f) which requires sponsors of SFSP closed enrolled sites to determine site eligibility through collecting income eligibility applications. The waiver would allow SFSP closed enrolled sites to determine site eligibility using methods described in SP08 CACFP04 SFSP03-2017 Area Eligibility in Child Nutrition Programs.
  • Meal service time restrictions requirements at 7 CFR 225.16(c)(1) and (c)(2) which set the minimum time that must elapse between meal services and limit the duration of meals.

TN DHS is requesting these waivers to better align SFSP 2022 with pre-pandemic SFSP operations. These waivers will be made available to approved sponsors participating in the 2022 SFSP that did not receive a notice of serious deficiency in SFSP 2021.
