Risk Management Program

Facilities that produce, handle, process, distribute, or store certain chemicals must develop and report to EPA an accident prevention plan. The Risk Management Plan (RMP) should include a hazard assessment, a prevention history, and an emergency response program.

In 1996, EPA established a list of extremely hazardous substances and issued regulations for the prevention and mitigation of accidental releases of those substances under section 112(r) of the Clean Air Act. Facilities covered by the regulations were required to implement a risk management program and submit their program's plan, (RMP) to EPA by June 21, 1999 and an update by 2004. RMPs must be updated at least once every five years, and most covered facilities must update their RMPs again by June 21, 2009.

If you submitted your initial RMP after June 21, 1999, or have resubmitted since your initial submission, your 5-year anniversary date is calculated as 5 years from the postmark date of your latest submission. Details may be found in the February 2004 EPA Factsheet-Checklist.

Risk Management Plans are very detailed and may require a considerable amount of time and effort to complete. The Small Business Environmental Assistance Program (SBEAP) has hosted workshops on this subject in the past and our staff may be able to assist your small business in achieving compliance with this air pollution regulation.

EPA is the implementing agency for this program in Tennessee and they may audit and review plans when they are submitted. For businesses located in Tennessee and that need to submit an updated RMP or a newly prepared RMP, your plan should be sent directly to EPA at the following address:
