Air Notices and Hearings

April 11, 2024

• There will be a public hearing before the Technical Secretary of the Board regarding the Rules Repeal. The hearing will be conducted in the manner prescribed by the Uniform Administrative Procedures Act, Tennessee Code Annotated sections 4-5-201 to -231 and will take place in Conference Room B of the Davy Crockett Tower, Floor 7, 500 James Robertson Parkway, Nashville, Tennessee 37243 on June 5, 2024, at 1:00 p.m.  The Air Pollution Control Board is proposing to repeal rules that were identified through the retrospective rule review as out-of-date, redundant, or as superseded by more recent federal regulations.  The following rules are proposed for repeal:  (1) Rule 1200-03-07-.06, (2) Chapter 1200-03-25, and (3) Rule 1200-03-27-.07. • There will be a public hearing before the Technical Secretary of the Board regarding the New Source Performance Standards (NSPS) rule revision. The hearing will be conducted in the manner prescribed by the Uniform Administrative Procedures Act, Tennessee Code Annotated sections 4-5-201 to -231 and will take place in Conference Room B of the Davy Crockett Tower, Floor 7, 500 James Robertson Parkway, Nashville, Tennessee 37243 on June 5, 2024, at 10:00 a.m. The proposed amendments to Chapter 0400-30-39 will incorporate by reference all New Source Performance Standards (NSPS) from 40 C.F.R. Part 60, except the emission guidelines. The Board proposes to repeal all of Chapter 1200-03-16 and one rule in Chapter 1200-03-06, which currently reproduce some, but not all, of the NSPS regulations. The proposed rule will incorporate by reference the federal NSPS regulations and allow the Technical Secretary of the Board to enforce these federal regulations directly. • A public hearing will be held by Tennessee Division of Air Pollution Control (TDAPC) pursuant to TAPCR 1200-03-09-.01(4)(l)(v) regarding the preliminary determination and draft Prevention of Significant Deterioration (PSD) construction permits for a proposed expansion at Jack Daniel Distillery, Lem Motlow, Prop., Inc. On Thursday, April 25, 2024, at 5:30 p.m. CST, a public hearing will be held for participants to submit verbal comments concerning the TDAPC’s consideration and review of this proposed expansion. Prior to the public hearing, a public information session will be held to discuss the technical and regulatory air pollution-related issues concerning the permitting of the proposed expansion at 5:00 p.m. CST. • There will be a public hearing before the Technical Secretary of the Tennessee Air Pollution Control Board to consider a draft general permit for nonmetallic mineral processing plants under the authority of Tennessee Code Annotated, Section 68-201-105. Public Hearing Document
• The Division of Air Pollution Control is happy to announce the draft of a new, easier, and cost-effective permitting option for rock crushing and sizing operations called a General Permit. An informational webinar will be held on March 1, 2024, and representatives from the Division will explain the benefits of general permits and present the draft general permit. January 12, 2024

• There will be a public hearing on February 20, 2024, at 9:00 AM Eastern before the Technical Secretary of the Tennessee Air Pollution Control Board to consider the pre-hearing draft Knoxville Area Second Ozone Maintenance Plan (2008 Ozone NAAQS) under the authority of Tennessee Code Annotated, Section 68-201-105.  The hearing will be conducted as prescribed by the Uniform Administrative Procedures Act, Tennessee Code Annotated, Section 4-5-201 et. seq. and will take place at the date, time and location indicated in the Notice of Hearing.  The public hearing has been called to consider the pre-hearing draft Knoxville Area Second Ozone Maintenance Plan (2008 Ozone NAAQS).  This pre-hearing draft Maintenance Plan was prepared in accordance with Section 175A of the Clean Air Act and the U.S. Environmental Protection Agency's (EPA) guidance documents. The Maintenance Plan includes an attainment emissions inventory, maintenance demonstration, monitoring data, verification of continued attainment, motor vehicle emission budgets (MVEB), and a contingency plan.
